These Terms of Service ("Terms") govern your use of the Dartrak mobile application ("the app", "Dartrak"). By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.
These Terms incorporate our Privacy Policy (privacy-policy.en.html), which forms an integral part of them.
1. Publisher
The app is published by:
- Pixware Studio, trade name of the publisher (sole proprietorship, France)

(hereinafter "we", "us", "our").
2. Acceptance and capacity
- By using the app, you confirm that you have the legal capacity to enter into this agreement.
- The app is intended for a general audience (content rating PEGI 3 / "Everyone"). If you are a minor, you must use it under the responsibility of a parent or guardian.
- The optional account and cloud sync features (section 6) require you to be at least the age of digital consent in your country (15 in France), or to have parental consent.
3. Licence grant
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the app on devices you own or control, for personal, non-commercial purposes. This licence transfers no ownership rights in the app to you.
4. Restrictions
You agree not to, and not to allow any third party to:
- copy, modify, translate, adapt, or create derivative works of the app, except as permitted by mandatory law;
- reverse engineer, decompile, or disassemble the app, except as expressly permitted by law;
- distribute, rent, lease, lend, resell, or commercially exploit the app;
- circumvent, disable, or interfere with security features or any paid features;
- use the app for any unlawful purpose or in breach of these Terms.
5. Local operation and no account
- By default, Dartrak works 100% offline, with no account. Your game data is stored locally on your device.
- No connection or registration is required to use the core of the app.
6. Account and cloud sync (optional)
- You may optionally sign in (e.g. with Google) to back up your games and use social features (friends). This layer stays inert until you sign in.
- You are responsible for keeping your credentials confidential and for activity carried out through your account.
- Related data processing is described in the Privacy Policy.
7. Your data and backups
- Your local data belongs to you and remains under your control. The app provides export / import for your backups.
- You are responsible for backing up your data. To the extent permitted by law, we are not liable for loss of local data resulting from uninstalling the app, or from loss or failure of your device.
8. Score accuracy and game rules
- Dartrak is an assistance tool for scoring and training. Manual, voice, and (in the future) camera input may contain errors.
- You are responsible for verifying score accuracy. Dartrak must not be used as an official referee for competition.
- Dartrak applies rules published by governing bodies (PDC / WDF) for informational purposes. Dartrak is not affiliated with, endorsed by, or sponsored by the PDC, the WDF, or any other darts organisation. Trademarks mentioned belong to their respective owners.
9. Physical safety
Darts are sharp objects. You use the app as part of a physical activity: play responsibly, in a suitable and safe environment. To the extent permitted by law, we disclaim any liability for injury, property damage, or harm resulting from playing darts or from using your device while playing.
10. Intellectual property
The app, its code, design, text, graphics, sounds, and detection model(s) are protected by intellectual property law and are owned by us or used under licence. No rights are granted to you beyond the licence in section 3.
11. Third-party and open-source components
The app includes third-party and open-source components governed by their own licences. The upcoming camera scoring feature relies on a model trained on dataset(s) under a CC-BY (attribution) licence, credited within the app ("Licences" screen) and/or its documentation.
12. Third-party services and distribution platforms
- The app is distributed via platforms (in particular Google Play), whose terms apply in addition to these.
- Some optional features rely on third-party services: Google sign-in, cloud hosting (Supabase), and your operating system's speech recognition. Use of these services is governed by their own terms and privacy policies. We are not responsible for third-party services.
13. Paid features (upcoming)
- Dartrak's game core is and will remain free.
- We reserve the right to introduce optional paid features in the future (for example camera scoring and an "advanced" layer), via one-time purchase and/or subscription.
- Any purchase will be processed by the platform's billing system (Google Play / App Store) and subject to dedicated terms of sale presented at the time of purchase. These Terms will be updated accordingly.
14. Availability, updates, and changes
We may change, update, suspend, or discontinue all or part of the app. We strive for correct operation but do not warrant uninterrupted or error-free availability.
15. Warranties
To the extent permitted by law, the app is provided "as is" and "as available", without warranty of any kind (including fitness for a particular purpose or freedom from errors). Nothing in these Terms excludes or limits your mandatory consumer rights (including the legal guarantee of conformity), which remain fully applicable.
16. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for loss of data or profits. Nothing in these Terms limits our liability for fraud, gross negligence, personal injury, or in any other case where the law prohibits such limitation.
17. Termination
The licence terminates automatically if you breach your obligations under these Terms. You may stop using and uninstall the app at any time. Sections intended to survive (intellectual property, warranties, liability, governing law) remain in effect after the licence ends.
18. Governing law, disputes, and mediation
- These Terms are governed by French law, without prejudice to the mandatory consumer protection provisions of your country of habitual residence in the European Union.
- In the event of a dispute, please contact us first to seek an amicable solution.
- Once the app offers purchases, you will be able, under French law, to use a consumer mediator free of charge; their details will be listed here and in the terms of sale.

19. Changes to these Terms
We may update these Terms to reflect changes in the app or the law. Material changes will be indicated by updating the date above. Continued use after a change takes effect constitutes acceptance.
20. Miscellaneous
- If any provision is held invalid, the remaining provisions stay in effect.
- These Terms, together with the Privacy Policy (and any terms of sale, where applicable), constitute the entire agreement between you and us regarding the app.
- Failure to exercise a right is not a waiver of that right.
